We collect the personal data of the following types of people to allow us to undertake our business activity:
- Prospective and placed candidates for permanent and/or temporary roles;
- Prospective and live client contacts;
- Supplier contacts to support our services;
- Current and former employees, contractors and temporary workers.

At August Clarke Ltd we understand the importance of protecting and respecting the confidentiality of our clients and candidates and inline with recent changes to European Law known as GDPR we have updated our Privacy Statement and Terms of Business.
August Clarke Ltd adhere to the following Privacy Statement: English law and jurisdiction applies with respect to the content of this notice and the information contained. In particular, August Clarke Ltd recognise and address our obligations under the provisions of the Data Protection Act (1998).
Data Collection
We collect information from all users of August Clarke Ltd services, whether this is via our website, in person or via an affiliated partner. August Clarke Ltd will collect data required to carry out work finding services. This includes but is not limited to: CV’s, identification documents, educational records, work history, employment (possibly including salary and benefit details), references and links to your professional profiles available in the public domain, for example, LinkedIn.
Candidates: The following are the different sources we may collect personal data about you from:
- Directly from you: This is information you provide while searching for a new opportunity and/or during the different recruitment stages. It may include information that you provide via emails, phone conversations, face to face meetings and website submissions.
- From an agent/third party acting on your behalf: For example, a Contractor’s Personal Service Company.
- Through publicly available sources: We use the following public sources:
- Corporate websites
- Job Board websites
- Online CV libraries
- Social media platforms
- Online portfolios/ blogs
- Technical IT User Groups
- By Reference or word of mouth: For example, you may be recommended by a friend, a former employer, a former colleague or even a present employer.
How and when August Clarke Ltd collect information
Information is collected via our website and independent external job boards. Information is also voluntarily provided to us by candidates and clients when creating an account or signing up for our services. Personal information relating to an individual is collected during candidate registration interviews, telephone calls, email correspondence and reference checks. Client information is also collected during meetings, telephones calls and events August Clarke Ltd attend or host.
In addition to the information provided August Clarke Ltd collect and check data from third parties such as companies house and accredited bodies.
Information created when you use our services
If you are a client, August Clarke Ltd will collect details about the company such as: company registration details, structure, contact information and role details.
If you are a candidate (job seeker) August Clarke Ltd will collect personal data, name, address, date of birth, employment history, right to work, qualification membership details, and references.
The legal basis for using your information
Our legal basis for the processing of personal data is our legitimate business interests, described in more detail below, although we will also rely on contract, legal obligation and consent for specific uses of data.
We will rely on contract if we are negotiating or have entered into a placement agreement with you or your organisation or any other contract to provide services to you or receive services from you or your organisation.
We will rely on legal obligation if we are legally required to hold information on you to fulfil our legal obligations.
We will in some circumstances rely on consent for particular uses of your data and you will be asked for your express consent, if legally required. Examples of when consent may be the lawful basis for processing include permission to introduce you to a client (if you are a candidate).
Should we want or need to rely on consent to lawfully process your data we will request your consent orally, by email or by an online process for the specific activity we require consent for and record your response on our database. Where consent is the lawful basis for our processing, you have the right to withdraw your consent to this particular processing at any time.
We may contact you by phone, text message, email, post or social media. If you prefer a particular contact means over another please just let us know.
CANDIDATES
Candidate data is kept and used under the use of consent and in compliance with Principle 1, Article 5 of the GDPR. August Clarke Ltd do not sell or share your personal information to third parties for third party direct marketing purposes. August Clarke Ltd will use your information to deliver personalised work finding services and optimise your August Clarke Ltd experience. Data will be collated onto our internal systems and all paper documents will be securely stored on each site. August Clarke Ltd will use information collected to:
- Source and match roles and companies to your requirements
- Submit your CV and any other relevant information to clients in the process of providing work finding services
- Communicate with candidates regarding your job search via email, phone, text message or post
- Update candidates on events and announcements which may be of interest in relation to August Clarke Ltd providing current or future work finding services
- Undertake research and analysis to enhance August Clarke Ltd’s work finding services
- Process payroll and comply with Auto Enrolment and HMRC requirements
- Meet our Health & Safety obligations as per UK statute
We will share your personal information with third parties where required by law, where it is necessary to administer the working relationship with you or where we have another legitimate interest in doing so. We will also share your personal information with third parties with whom you are seeking employment or engagement by engaging our services as recruitment consultants. We may also share your personal information with third parties to whom you are assigned to work while employed by us. This may include providing your prospective employer or the company to which you are assigned with sensitive personal data such as copies of your passport or other identity documents.
CLIENTS
Client data is obtained, kept and used under the use of legitimate interest and in compliance with Principle 1 and Article 5 of the GDPR. Data will be collated onto our internal systems and all paper documents will be securely stored. August Clarke Ltd will use information collected to:
- Discuss present and future organisational recruitment requirements
- Allow August Clarke Ltd to compare August Clarke Ltd candidates with organisational vacancy requirements
- Provide candidate CVs and any other relevant candidate information
- Update clients on events and announcements which may be interest in relation to August Clarke Ltd supporting current or future organisational recruitment strategy
- Manage processes throughout the recruitment cycle including but not limited to: interviews, feedback, offers and timesheet authorisation.
- Process credit checks and raise invoices for services provided
- Undertake research and analysis to enhance August Clarke Ltd’s recruitment services
- Recommend service partners, where agreed details will be passed onto our selected partners
Data Sharing & Disclosure
Except as set out herein and where required or permitted by law or a court of competent jurisdiction, August Clarke Ltd will not reveal any personal data about you to any third party.
Information will be shared internally within the August Clarke Ltd team to provide work finding, recruitment and payroll services. August Clarke Ltd will only share information with third parties when required as part of our work finding or recruitment services. August Clarke Ltd may check information collected with third parties or with other information held by August Clarke Ltd. Candidate’s personal data will only be shared with August Clarke Ltd clients who have a legitimate interest and only then with the candidate’s permission.
Your data may be disclosed to any person, firm or company to whom we sell the whole or a substantial part of our business or to whom we may transfer any part of our rights or obligations. We may also disclose your information where necessary to enforce our Terms of Business or other agreements or if necessary to prevent, detect or prosecute illegal or suspected illegal activities or to prevent other damage in response to a legal action against August Clarke Ltd.
How do we protect your information?
Your personal data security is our highest priority. August Clarke Ltd have taken steps to protect your information by limiting the access to our network and locations where your data is stored. Our team only access data which is required to complete their job function. Further information on the security features of our system are available on request. Although we do our best to protect the information you share via the internet, anything you submit via the internet is done so at your own risk.
Information retention & deletion
During the time you are registered as active with August Clarke Ltd we will log calls, emails, meetings, texts, events and any other relevant information on our secure internal database. At this time no option exists for third party access. If a decision is made to change this aspect of the database, then we will seek your consent first. While all reasonable security measures have been implemented, August Clarke Ltd are unable to accept responsibility for intrusion by third parties acting illegally.
During our marketing activities, August Clarke Ltd log who, when and where our mailers have been opened and viewed.
August Clarke Ltd also obtain data from publicly available sources, financial service providers, governing bodies and referees. August Clarke Ltd may combine information collected from these sources with information already in its possession.
Our data is stored on external servers, which are monitored and protected 24hrs a day. All personal information is stored on secure servers.
We will only retain your personal information for as long as necessary to fulfil the purposes we collect it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
In some circumstances, we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.
If you request that your details are completely removed from our database, then there is a chance that we may contact you again if your details are found through publicly available sources. We suggest that you allow us to minimise your data, so that we know not to approach you. Minimising data is when we retain basic identifying information (name, company name, email address and publicly available details, for example, a LinkedIn hyperlink).
Once you are no longer an employee, worker or contractor of the company we will retain and securely destroy your personal information in accordance with applicable laws and regulations.
Access to your personal data
By law, you have a number of rights when it comes to your personal data. Further information and advice about your rights can be obtained from the data protection regulator in your country.
